Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website located at www.spectrumstream.org and the services offered by Spectrum Stream Security Technologies Pty Ltd (ABN pending), operating as SpectrumStream (“SpectrumStream”, “we”, “us”, “our”), headquartered in Melbourne, Victoria, Australia. By accessing our website or engaging our services, you (“Client”, “you”, “your”) agree to be bound by these Terms. If you do not agree, you must not use our website or services.

SpectrumStream provides the following services, subject to separate formal service agreements or statements of work (SOWs) where applicable:

• Managed IT Services (MSP) including remote support, monitoring, patching, endpoint security, vendor management, and cloud infrastructure management
• Cybersecurity Services including penetration testing (conducted in partnership with Aussie Pentest Pty Ltd), Essential Eight compliance, vCISO advisory, EDR/XDR deployment, and AI-assisted threat detection
• Web Development & Hosting including custom website development, managed hosting on Vercel/AWS, WAF and DDoS protection, and secure hosting bundles

Service-specific terms, scope limitations, and deliverables will be documented in individual engagement agreements or SOWs signed prior to commencement.

• MSP pricing is charged on a per-user, per-month basis as published on our website (excluding GST). MSP plans require a minimum of ten (10) users.
• Web hosting is billed monthly per site. Web development is quoted per project.
• All prices are in Australian Dollars (AUD) and exclude GST unless stated otherwise.
• Invoices are due within fourteen (14) days of issue unless agreed otherwise in writing.
• Late payments may incur interest at a rate of 10% per annum, calculated daily.
• SpectrumStream reserves the right to suspend services for accounts overdue by more than thirty (30) days.

You agree to:

• Provide accurate and up-to-date information when engaging our services
• Obtain all necessary authorisations before permitting SpectrumStream to access your systems, networks, or data
• Not use our services for any unlawful purpose
• Notify us promptly of any changes to your environment that may affect service delivery
• Maintain appropriate insurance and comply with all applicable laws

You must not use our website or services to:

• Engage in any activity that is illegal under Australian law
• Attempt to gain unauthorised access to any systems or networks
• Transmit malicious code, spam, or harmful content
• Infringe the intellectual property rights of any party
• Interfere with the integrity or availability of our systems

We reserve the right to terminate access to any client who violates these conditions without notice and without refund.

All penetration testing services are conducted by or in partnership with Aussie Pentest Pty Ltd. Prior to commencement of any security assessment, the Client must:

• Provide written authorisation confirming ownership or legal right to authorise testing of all in-scope assets
• Execute a separate Penetration Testing Agreement defining scope, rules of engagement, and liability limitations
• Ensure that all relevant third parties (such as cloud providers and hosting companies) have been notified where required

SpectrumStream and Aussie Pentest Pty Ltd accept no liability for damage arising from testing conducted outside the agreed scope or without proper authorisation.

All content on this website, including text, graphics, logos, and software, is the property of Spectrum Stream Security Technologies Pty Ltd or its licensors and is protected by Australian copyright law. You may not reproduce, distribute, or create derivative works without our prior written consent.

Reports, documentation, and deliverables produced under an engagement agreement are provided to you under a limited licence for internal business use only, unless otherwise agreed in writing.

Both parties agree to keep confidential any proprietary or sensitive information disclosed in connection with service delivery. This obligation survives the termination of any service agreement. SpectrumStream will not disclose client data to third parties except as necessary to deliver contracted services or as required by law.

To the maximum extent permitted by Australian law:

• SpectrumStream's total liability to you for any claim arising from or relating to our services shall not exceed the total fees paid by you in the three (3) months preceding the event giving rise to the claim.
• We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data loss, or business interruption.
• We do not warrant that our services will be uninterrupted, error-free, or free from security vulnerabilities.

Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law.

Either party may terminate a service engagement by providing thirty (30) days written notice, unless a different notice period is specified in the relevant service agreement. We may terminate immediately if you breach these Terms or fail to pay invoices after reasonable notice.

Upon termination, you remain liable for all fees incurred up to the date of termination.

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.

We may update these Terms from time to time. Continued use of our website or services after changes are published constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
